Acceptance of Terms: By participating in the PG Pool and Spa Referral Program (“Program”), you acknowledge and agree to be bound by the following Terms and Conditions, together with our general Terms of Service, and all applicable laws and regulations. Please review the terms outlined below; should you disagree with any of these terms, please refrain from participating in the Program.

Changes to Terms: The PG Pool and Spa reserves the right to update, amend, or discontinue the Program at any time without prior notification. Any changes will be effective immediately upon posting on our website. We encourage you to review these terms regularly. Your continued participation following any modifications constitutes your acceptance of the updated terms.

Scope of Program: The Program is offered as a promotional service designed to reward existing customers of PG Pool and Spa for referring new customers who establish qualifying service contracts. Referral rewards are issued only under the conditions and limitations set forth below.

The Program is strictly promotional in nature and does not create any partnership, employment relationship, or joint venture between PG Pool and Spa and the participant.

Eligibility Requirements for Referrers: To be eligible to participate, the Referrer (the existing customer) must:

• Be an active PG Pool and Spa residential or commercial service customer in good standing.
• Maintain all payment obligations under their existing service agreement.
• Not refer themselves, any address they own or manage, or any member of their own household.
• Provide accurate and truthful information regarding the referred customer.
• Understand that participation in the Program does not alter or modify any other obligations under the Terms of Service.

PG Pool and Spa reserves the right to verify eligibility prior to issuing any reward.

Eligibility Requirements for Referred Customers: A referred customer qualifies only if each of the following conditions are met:

• They have never been a PG Pool and Spa customer at the referred property within the past 24 months.
• They sign a minimum 12-month weekly pool care service agreement.
• They complete their first full monthly billing cycle at the standard service rate.
• Their first invoice is not prorated, discounted, or reduced in any manner, and must total at least $219 before tax.
• They pay their first full qualifying invoice in full and on time.
• They remain active and in good standing through the first billing cycle.

If the referred customer’s first month is prorated below $219 or reduced for any reason, the referral reward will not be issued.

Referral Reward Structure: Referrers who meet all Program requirements may receive one of the following reward options:

• Amazon Digital Gift Card: A Amazon Digital Gift Card will be delivered by email. The official Amazon eGift Card email will be forwarded directly to the Referrer. PG Pool and Spa does not own, operate, or control Amazon, its services, its redemption systems, or the availability of Amazon gift cards. PG Pool and Spa’s obligation ends upon forwarding the original, unaltered Amazon eGift Card email to the Referrer. Any issues related to the redemption, validity, misuse, technical error, or loss of the claim code must be resolved directly with Amazon.
• Account Credit Alternative: Upon request by the Referrer, PG Pool and Spa will apply a credit to the Referrer’s next scheduled invoice in place of the Gift Card.

Referral rewards carry no cash value and may not be redeemed, transferred, assigned, or substituted except as expressly stated herein.
Rewards are limited to one Referrer per referred customer.

Trademark Notice: Amazon is not a sponsor of this promotion. Amazon, Amazon.com, and the Amazon logo are trademarks of Amazon.com, Inc. or its affiliates. PG Pool and Spa uses the term ‘Amazon Digital Gift Card’ solely to describe the reward option available. PG Pool and Spa has no affiliation with Amazon other than the lawful purchase and distribution of digital gift cards.

Reward Issuance and Processing: Referral rewards are issued only after:

• PG Pool and Spa confirms that all requirements for both the Referrer and the Referred customer have been satisfied.
• The Referred customer completes and pays their first full, non-prorated monthly billing cycle (minimum $219).
• No cancellation, service dispute, or payment issue is pending on either account.

Rewards are typically processed within 30 days following the referred customer’s qualifying payment, though processing times may vary.

PG Pool and Spa retains the sole discretion to approve or decline issuance of any referral reward.

Prohibited Conduct: The following actions constitute violations of these Terms and will void all referral rewards:

• Self-referrals or household referrals.
• Dishonest, deceptive, or misleading representation of the Program.
• Creating false accounts or referring non-genuine customers.
• Attempting to circumvent eligibility requirements or manipulate program rules.
• Abuse of the Program, including mass referrals, automated submissions, or commercial promotion.

Any suspected abuse will result in immediate disqualification and may result in further action as permitted by law.

Tax Obligations: Referral rewards are treated as promotional incentives and may be deductible marketing expenses by PG Pool and Spa under applicable IRS regulations. Customers receiving referral rewards are responsible for complying with any personal tax obligations that may arise.

If a participant receives $600 or more in referral rewards in a calendar year, PG Pool and Spa may require a completed IRS Form W-9 and may issue a Form 1099-NEC as required by law.

Limitation of Liability: PG Pool and Spa shall not be liable for any indirect, incidental, special, or consequential damages arising from participation in this Program. Your sole remedy for any claim related to the Program shall be limited to the amount of the referral reward, if any, to which you are entitled under these Terms.

PG Pool and Spa assumes no liability for errors in referral submissions, lost or misdirected communication, or technological issues of any kind.

Indemnification: By participating in the Program, you agree to indemnify, defend, and hold harmless PG Pool and Spa, its owners, employees, contractors, and affiliates from all claims, damages, losses, liabilities, and expenses arising out of your participation, violation of these Terms, or misrepresentation relating to the Program.

Disputes: Any dispute arising out of or relating to this Program shall be resolved in accordance with the arbitration procedures outlined in the PG Pool and Spa Terms of Service. All disputes must be initiated within 30 days of the date the referral reward is issued or denied.

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any legal action shall be brought exclusively in Harris County, Texas, unless otherwise required by the arbitration clause referenced above.

Severability: If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Acceptance of Terms: Your participation in the PG Pool and Spa Referral Program constitutes:

• Acknowledgment that you have reviewed and understood these Terms.
• Agreement to be bound by all Program requirements, obligations, and limitations.
• Acceptance that these Terms form a legally binding contract between you and PG Pool and Spa.

If you do not agree to these Terms, please discontinue participation in the Program.
